NewswireTODAY - /newswire/ - Manville, NJ, United States, 2010/10/22 - Ramon Guzman, a Peruvian immigrant recently won a civil-rights jury lawsuit which was filed in the Superior Court of Essex County with the representation of his lawyer, Ed Rebenack from RAMM Law for being imprisoned wrongfully for 10 months.

Guzman was awarded $300,000 for wrongful imprisonment which was one of the largest settlements for allegations of police misconduct in Newark recently. "There’s really no amount of money that would have compensated Ramon," said Guzman’s lawyer, Edward Rebenack. "It was more important to him to expose what the Newark police did to him."

Guzman was presented a confession in English by a Newark police officer that Guzman could not read. At least three other police officers reviewed the confession and signed off on the paperwork. If any of the officers would have done a check, they would have realized that Guzman was in jail for overdue fines and physically could not have committed the crime he was arrested for and being charged with. This case shows the over eagerness of Newark police to close hard to solve theft cases.

Ramon Guzman sued Detective Douglas Marshall, the arresting officer for false arrest and sued Newark for failing to properly train its officers. Three other officers were also named in the lawsuit. Marshall’s lawyer said the suit was settled because Guzman’s case was sputtering. But Rebenack said Newark’s settlement offer rose throughout the trial, from $75,000 to $300,000. A Newark spokeswoman said the settlement, which still needs City Council approval, helps "limit any potential exposure."

Detective Douglas Marshall, the arresting officer and the city of Newark still have not admitted any wrongdoing despite Guzman and RAMM Law’s recent win. Newark Police spokesman Detective Todd McClendon said that internal affairs has launched a review of the entire incident. Detective Marshall is still a detective in the Fifth Precinct and his supervisor at the time of the arrest has been promoted to lieutenant.

"From Ramon’s perspective, it’s unfortunate that Detective Marshall was able to violate his civil rights, have the city of Newark pay for his wrongdoing and continue in his same role," Rebeneck said.
