The family of a Waco, Texas man who was killed in a pick-up truck roll over accident in June have filed suit against General Motors Corporation in the 170th District Court, McLennon County, Texas.
On or about June 21, 2008, Fernando Rodriguez Calvillo and Jacqueline Chavez Zamora were the belted right front and right rear occupants, respectively, of a 1995 Chevrolet C1500 being operated by Defendant Benjamin Chavez Villa that was involved in a rollover while traveling on Highway 85D, Monterrey-Laredo Autopista.
As Mr. Chavez unsuccessfully attempted to regain the roadway and control of the vehicle, the C1500 rolled over, coming to rest on its wheels. During the incident, the roof structure of the C1500 deformed, the side window glazing broke out, and the seat belts worn by Fernando Rodriguez Calvillo and Jacqueline Chavez Zamora failed to properly couple them to their seats and/or fully contain them within the vehicle.
Fernando Rodriguez Calvillo sustained traumatic head injuries from which he died. Plaintiff Jacqueline Chavez Zamora sustained serious injuries in the incident but survived.
The suit says the vehicle's seat belt restraint system was inadequate to provide proper occupant restraint, occupant containment and injury prevention in accidents, including rollovers.
The vehicle's roof structure is inadequate to withstand reasonably foreseeable applied forces and energies and also exposes occupants to possible exterior contact by increasing the chance of side glazing failure.
The vehicle's side window glazing is of tempered glass which shatters and vacates the window openings, allowing for partial ejection of occupants and failing to provide structural support to the vehicle's roof.
And the vehicle's side window glazing, roof structure and seat belt restraint system violate the basic principles of occupant containment design.
“The roll over epidemic continues to strike down hard working men and women,” said attorney Rob Ammons.
