With an ever increasing frequency, expert reports are being required in bankruptcy preference cases. While no numbers are available, anecdotal evidence suggests this is becoming the norm rather than the exception. Trustees are becoming more aggressive in pursuing preferences, explains Hal Schaeffer, a bankruptcy preference expert and president of D&H Credit Services, Inc, and defendants are fighting back even harder. We’re now getting requests for expert reports in smaller cases as well as the larger ones. In fact, says Schaeffer, many of our requests are coming from groups who have never had to get an expert report in the past – and quite a few don’t really understand what the bankruptcy preference expert does.
That is why D&H Credit Services, Inc. has created a CD that explains what every bankruptcy attorney needs to know about preference experts. Its new CD provides a credible explanation of what a bankruptcy preference expert can do and what skills and experience attorneys should look for when hiring one. The hour long CD is being purchased by law firms for their legal library and use at staff luncheons for their associates in the bankruptcy department.
