The Australian Government has announced a major reform to its skilled migration programme which significantly changes the way in which people can apply to migrate to Australia.
The new Skilled Migration Selection Model, or ‘Skill Select’ as it is known will be effective from 1 July 2012 and will remove an Australian skilled visa applicant’s ability and right to apply for an Australian skilled migration visa.

Potential applicants must first lodge an ‘Expression of Interest’ from which the Australian government, or Australian state governments, will select the applicants they deem to be the ‘best and brightest’, migrants to fill available places in the Australian migration programme.

If you are selected to apply for an Australian visa, you then must lodge your visa application within 2 months of the invitation.

This means that you must complete a skills assessment and sit and receive your International English Language Test Score (IELTS) before you lodge your expression of interest (EOI) or you simply will not be ready to lodge a valid application in time.

The Australian government has set the pass mark at 65 points but will invite the highest scoring applicants (e.g. 80+ points) and as available places in each occupation fill, invitations will cease and errors or inaccuracies in the EOI may lead to a refusal of your visa. This means the EOI stage of your Australian visa application is going to be a critical phase.
The Skilled Occupation List (SOL) will also be regularly reviewed and the Australian government has already announced changes to the SOL effective 1 July 2011.

Stewart Coulson Director and Immigration Solicitor at Turner Coulson Immigration Lawyers says ‘Australian skilled migration law and processes are constantly changing. If your occupation is in high demand, it is likely to be on, or added to, the Australian skilled occupation list (SOL) and also have more places within the skilled migration programme allocated to it.

‘Also there may be other employer or state sponsored options that will give you Australian permanent residence in a matter of months only and you should consider these options as well as seeking independent migration.

‘Therefore any advice and assistance you receive must consider your skills and characteristics as well as other variables like Australian labour market forces.’

Visit tcilawyers.com.au for further information on migration to Australia or contact Stewart or Ray at Turner Coulson Immigration Lawyers to discuss your best option.
