Judge has reversed a zoning decision that blocked the construction of a wireless communications tower in the city of LaPorte. Superior Court Judge Steven King ruled Horvath Communications of South Bend, IN met all statutory requirements and the LaPorte Board of Zoning Appeals had no discretion to deny the application for a special use permit to construct the tower. Judge King also ordered the BZA to issue the permit to Horvath Communications within 30 days of his order.

Horvath Communications (horvathcommunications.com), a leading developer and manager of wireless cell phone towers in the Midwest, filed an application for a special use permit to build a199 foot tower on the south side of Clear Lake in October of 2005. The LaPorte Board of Zoning Appeals denied the application in February, 2006 citing unsubstantiated concerns for “public safety.” In his written ruling Judge King dismissed those concerns: “the board’s finding and determination lacks evidentiary support, is clearly erroneous, constitutes an abuse of discretion, and must be reversed.”
