On January 17, 2007 TASC board members met with high-level representatives of the FTC, including Peggy Twohig, Associate Director of the FTC bureau of Consumer Protection; Alice Hrdy, Assistant Director of the Division of Financial Practices; and Michelle Grajales, Attorney for the Division of Financial Practices. These FTC representatives welcomed TASC inside the FTC, and carried on a candid discussion over their concerns about settlement company marketing, compliance, and consumer protection. Although, not an official position of the FTC, each representative received and reviewed copies of the TASC disclosure statement, position paper and other relevant documents.
The FTC welcomed and encouraged maximum disclosure by TASC member companies to consumers. The FTC stated that its most significant concern with the industry was that consumers receive sufficient, clear and understandable promises and terms within the bounds of applicable law. The FTC agreed to maintain an ongoing, open line of communication with TASC. The FTC also indicated its informal, but genuine satisfaction with TASC and its member companies as long as consumers receive the maximum protection, and pointed to TASC's consumer-friendly website as a welcome example of consumer information and protection.
At nearly the same time, TASC's counsel, Robby H. Birnbaum of Greenspoon Marder, P.A., carried on a brief discussion with the FTC's Division of Marketing Practices relating to proper disclosures for consumer-debt assistance companies, and current enforcement concerns.
The specifics of TASC's unique and comprehensive approach to reaching out to the FTC and building bridges to benefit its members will be discussed in detail at the upcoming annual convention in Las Vegas.
Monitoring, enforcement, and consumer protection strategies of the FTC will be brought to the table and analyzed by Mr. Birnbaum and the FTC, with the goal of positioning each member to maintain a favorable position in front of one of our most important government partners.
